Product Specific Terms

These Product Specific Terms are intended to provide additional details about our Integrations and form an integral part of our Terms and Conditions (https://datawarehouse.io/terms-conditions) (“Agreement”), and are hereby incorporated therein by this reference. If you are using any of the Integrations described below, the terms corresponding to those Integration(s) apply to your use. Capitalized terms not otherwise defined herein have the meaning set forth in our Terms and Conditions. We reserve the right to modify these Product Specific Terms at any time by posting an updated version on the Site.

Please read these Product Specific Terms carefully before using any of our Integrations.

1. Integration Types. Our Integrations are designed around common characteristics and features (“App Types”), which control how we access and process your Customer Data, the region where Customer Data can or will be hosted, and other characteristics applicable to the use of such Integrations. A list of our Integrations and corresponding App Types is provided as Exhibit A (Integration Details) of these Product Specific Terms.

• • 1.1 App Type 1. App Type 1 describes Integrations that connect Customer Data between one Third-Party Service database (“Origin Source”) with one provided by us, you, or a Third-Party Service (“Destination Source”).
  • 1.2 App Type 2. App Type 2 describes Integrations that provide an export-only function whereby Customer Data is accessed and exported in the format (i.e., Excel, Google Sheets), and to the source (i.e., email), identified at the time of export through the Integration.
  • 1.3 App Type 3.  App Type 3 describes Integrations that provide you with the ability to migrate Customer Data from the Origin Source to a new Destination Source.

2. Access to Data. Our Integrations require us to access your Customer Data in order to function. Generally speaking, you grant us read only access to your Customer Data stored in the Origin Source. You acknowledge that by authenticating the applicable Origin Source, you are granting us API access, which provides us with access to Customer Data via an OAuth Token. How we protect and use Customer Data which you grant us access to is described in our Data Processing Agreement. Customer Data is transferred from the Origin Source and processed through our servers (or in some cases, your servers) provided by third party cloud hosting providers (“Processing Source”).

3. Available Regions. The following Regional Data Hosting defaults are applicable to each App Type. If you need data hosting other than as provided below, please contact us at help@datawarehouse.io.

• • 3.1 App Type 1. Customer Data may be processed and stored in either the United States or Europe. The applicable Region will either be assigned by default based on your billing address, or selected by you (if such option is available) upon purchase of the Integration. Subscribers located in the United States, including all US territories, as well as North and South America in general, will have their Customer Data hosted in the United States by default. Subscribers located outside of these locations will have their Customer Data hosting in Europe by default.
  • 3.2 App Type 2. Customer Data is always processed and stored in the United States.
  • 3.3 App Type 3. Customer Data is always processed in Europe.

4. Deletion of Customer Data. Unless otherwise specified in a separate agreement between you and us, and unless we are required by law, we will delete all Customer Data, if any, stored on Datawarehouse.io servers on or after the time period specified in Exhibit A for each Integration (“Deletion Timeline”). If you wish to retrieve a copy of your Customer Data, you are advised to make such a request to us before cancellation or expiration of any Subscription Services applicable to your Customer Data.  We will provide you with reasonable assistance, at your cost, to help you to retrieve your Customer Data stored on Datawarehouse.io servers only.

5. GDPR Compatible. We intend to provide Integrations in App Type 1 and App Type 3 to be compatible with the GDPR. In accordance with our Customer Terms and Conditions, we cannot guarantee that all Integrations are or will continue to be GDPR compatible. Exhibit A indicates, to the best of our knowledge, whether each Integration is or is not GDPR compatible. The representation provided in Exhibit A is for informational purposes only and should not be construed as a representation or warranty that such Integration is or will continue to be GDPR compliant.

Exhibit A – Integration Details

*Ultimate Data Export creates a read-only user we may or may not use in your HubSpot portal as part of the app installation process to troubleshoot as needed. You may remove this user at any time without notice or reason and it will not change the listed behavior of the application.
